w i t h , incorporate, address a n d i m p l e m e n t a l l provisions of t h i s A g r e e m e n t .
I n accordance w i t h p a r a g r a p h 68 of t h i s A g r e e m e n t , t h e State s h a l l create or
m o d i f y , as necessary, other w r i t t e n documents - such as screening tools,
handbooks, m a n u a l s , a n d forms - to effectuate t h e p r o v i s i o n s of t h i s
A g r e e m e n t . T h e State s h a l l s u b m i t a l l such documents t o t h e U n i t e d States
for r e v i e w a n d a p p r o v a l , w h i c h s h a l l n o t be unreasonably w i t h h e l d .

— w i t h r e g a r d to: t h e s t a t u s of t h e State's compliance or
noncompliance w i t h t h i s A g r e e m e n t ; any act or omission of t h e State
or i t s agents, representatives or employees; or t h e t e r m s of h i s or her
e m p l o y m e n t on the M o n i t o r i n g T e a m .
e. Except as r e q u i r e d or a u t h o r i z e d b y t h e t e r m s of t h i s A g r e e m e n t or t h e
Parties a c t i n g together, no M o n i t o r s h a l l testify i n a n y other l i t i g a t i o n
or proceeding w i t h r e g a r d to t h e status of the State's compliance or
noncompliance w i t h t h i s A g r e e m e n t ; any act or omission of t h e State
or i t s agents, representatives or employees; or t h e t e r m s of h i s or h e r
e m p l o y m e n t o n t h e M o n i t o r i n g T e a m , unless o t h e r w i s e l a w f u l l y
compelled t o do so. The M o n i t o r s m a y testify i n t h i s l i t i g a t i o n
concerning t h e State's compliance or noncompliance w i t h t h i s
Agreement.
h. M e m b e r s of t h e M o n i t o r i n g T e a m m a y be t e r m i n a t e d i f b o t h P a r t i e s
agree a n d u p o n good cause s h o w n . Good cause s h a l l include any
v i o l a t i o n of State or federal l a w w h i c h reasonably calls i n t o question
t h e M o n i t o r i n g T e a m member's fitness to continue s e r v i n g as a
member of t h e M o n i t o r i n g T e a m . I n t h e event t h e P a r t i e s do n o t agree
u p o n t h e need for t e r m i n a t i o n , t h e Parties agree to w o r k i n good f a i t h
to resolve t h e i r differences.

T h e f i r s t compliance r e v i e w w i l l be conducted a p p r o x i m a t e l y eight (8)

t e n (10) days, agree t o a schedule for t h e State t o s u b m i t revisions. I f
the U n i t e d States does n o t p r o v i d e w r i t t e n a p p r o v a l or concerns
r e g a r d i n g a document w i t h i n n i n e t y (90) days of receipt, t h e document
s h a l l be considered approved. I f , after t h e policies, procedures, a n d
practices affected b y t h i s A g r e e m e n t are i m p l e m e n t e d , a n y of t h e
Parties determines t h a t a policy, procedure, or practice, as
i m p l e m e n t e d , fails t o effectuate t h e t e r m s o f t h i s A g r e e m e n t , t h e State
s h a l l consult w i t h t h e U n i t e d States a n d revise t h e policy, procedure,
or practice t o effectuate t h e t e r m s of t h i s A g r e e m e n t .

i t s attorneys s h a l l have f u l l a n d complete access t o : t h e b u i l d i n g s a n d
grounds of each F a c i l i t y ; F a c i l i t y documents a n d records; O C F S documents
a n d records; F a c i l i t y officials, employees, agents, a n d i n d e p e n d e n t
contractors; O C F S officials, employees, agents, a n d i n d e p e n d e n t contractors;
a n d y o u t h r e s i d i n g a t t h e Facilities, i n c l u d i n g t h e r i g h t t o meet w i t h y o u t h
p r i v a t e l y . Such access s h a l l continue u n t i l t h i s A g r e e m e n t is t e r m i n a t e d i n

of t h e f o l l o w i n g categories of incidents: y o u t h d e a t h ; any y o u t h i n j u r y
r e s u l t i n g i n t r a n s p o r t of t h e y o u t h to t h e emergency room or r e q u i r i n g

defense exigent circumstances i n t h e State, i n c l u d i n g b u t n o t l i m i t e d t o :
economic recession, fiscal constraints, necessary d i v e r s i o n of resources a n d
personnel i n t h e event of w i d e s p r e a d t h r e a t to p u b l i c h e a l t h , a n act of w a r , or

and the New York State Office of Children and Family Services ("OCFS") ("the Parties")

Girls Center, and the Tryon Residential Center pursuant to the Civil Rights of liistitationalized.

is served on the DOJ seeking documents or information included in f 2, the D O J will assert all

redact or otherwise obscure the name or names of the individual(s) and shall redact or obscure

the home address of the mdividual(s), or substitute a pseudonym and/or other code. Where the
name or names and/or addresses are an integral part of a document or record, or obscuring the
name and/or address destroys the utility or understandability of the document or record, the
parties shall seek to file the document or record under seal of the Court.
