Can or will be able VPNSERVIS API "tap mode" of openvpn?
My employer has only allowed openvpn with tap mod.

No the Android Vpnservice API 
(http:https://developer.android.com/reference/android/net/VpnService.html) only 
allows tun mode. I don't think Google intends to implement tap for this API.

I am sorry but without rooting your telephone and not using the VPNService API 
this is not possible.
