Ballots were mailed to registered voters in the village by January 16, 2016. The deadline to submit mailed ballots for the recall election was 5:00pm on Tuesday, January 26, 2016.[2] The recall ballot asked for a "yes" or "no" vote on the question: "Shall Shaun Swan be removed from the office of Herman Village Board of Trustees?"[3]

Gary W. Kuhl and three volunteer circulators sought the removal of Swan from the village board for the following reasons:

During a board meeting discussion of stop sign removal, Swan clearly stated that he disregards (runs) the stop sign as he does not agree with it. Swan further stated that "If I get a ticket, then I'm breaking the law". Swan's admitted attitude toward ordinances and laws he disagrees with violates his oath of office. [4]

Recall supporters also cited Swan for failure to build a fence around his swimming pool and complaints about used tires stored outside of his shop.[5]

Swan issued the following response to the recall effort:

I speak openly and honestly about my position on issues affecting the Village. In fact, it is the duty of every elected official to speak candidly and truthfully at Village Meetings whether or not it is popular. If I remain in office I will continue to faithfully and impartially discharge my duties as required by my oath. [4]

Recall supporters submitted 50 signatures to the Washington County Clerk on November 2, 2015. The clerk certified 48 signatures as valid, which surpassed the 36 signatures required to force a recall election. Supporters received signatures from the entire planning commission, Trustee Kim Johnson, Village Clerk Vicky Kellogg and two former trustees.[2]
