The Georgia State-wide Business Court has concurrent jurisdiction with the Georgia Superior Courts over equity cases and cases involving securities, the commercial code, internal business affairs, professional malpractice resulting from a business dispute, breach of contract claims between businesses, and more as provided by law.[1]

Georgia law established one judge and one division for the state business court. The governor of Georgia appoints the business court judge, subject to approval by the judiciary committees of the state Senate and state House.[1]
The business court judge serves for five years and may be reappointed to consecutive terms, subject to reappointment and confirmation as described above.
Vacancies
In the event there is a vacancy on the business court, a new judge shall be appointed by the governor and confirmed by the state Senate and House judiciary committees.[1]
Qualifications
The Georgia State-wide Business Court judge must:
- Have been a Georgia resident and a United States citizen for at least seven years;
- Have been admitted to practice law in Georgia for at least seven years; and
- Have at least 15 years of legal experience in business litigation, either as an attorney or a judge.[1]
History of the court
On November 6, 2018, voters in Georgia approved Georgia Amendment 2, which supported amending the state constitution to establish a state business court and establish procedures and rules for judicial selection, term length, and judge qualifications for the court. In 2019, the Georgia State Legislature approved HB 239, laying out the details of the statewide business court and officially amending Georgia law. The court began taking cases on August 1, 2020.[1][2]
Georgia had two local business courts that had been implemented as pilot programs in Fulton County and Gwinnett Couty. The Fulton County business court had been operating since October 2005 and expanded to serve Gwinnett Superior and Gwinnett State Courts in July 2016. The purpose of the business court was "to provide judicial attention and expertise to certain complex business cases and to facilitate the timely and appropriate resolution of such disputes."[3]
